$9,500,000 Settlement – Motel Shooting

A construction worker staying at an Atlanta area motel was the victim of a robbery and shooting that left him with a permanent brain injury. Shiver Hamilton Campbell investigated the case and uncovered evidence establishing the owners and operators of the motel had reason to anticipate the incident and had multiple opportunities to intervene yet failed to do so. The assailants were allowed to rent a room at the motel despite the concerns of the front desk attendant. Over a period of hours after checking in, the assailants roamed the premises without any intervention by management. Their suspicious behavior was captured on the surveillance system, but no action was taken by management. Eventually the assailants gained entry to the victim’s room where he was robbed and shot.

Shiver Hamilton Campbell filed suit on behalf of the injured individual and his wife and litigated the case for more than two years. During litigation, Shiver Hamilton Campbell reviewed voluminous documents and took depositions of nearly twenty witnesses. At the outset of the case, the defendants denied any liability and placed the blame on the criminals. As a result of Shiver Hamilton Campbell’s aggressive and thorough pursuit of justice the case settled prior to trial for $9.5 million. The significant settlement allows the victim to get the continued care he will need for his permanent brain injury.
