$1,900,000 Jury Verdict – Premises Liability Forklift Accident

In December 2015, we obtained a jury verdict in Fulton County for our client who had neck surgery following an incident where a forklift backed into him while he was shopping at a local Restaurant Depot store. This was a fiercely contested case and trial. Our client had no visible injuries and did not immediately go to the hospital. The forklift driver and a supervisor testified that the forklift never actually hit our client at all, but instead only bumped into his shopping cart. We were able to expose inconsistencies in those witnesses’ stories on cross-examination at trial. The store also failed to preserve surveillance tape that would have possibly shown the incident.
