Why It Is Important To Put Your Uninsured/Underinsured Motorist Insurance Carrier On Notice Of Your Accident

When you are involved in a car wreck, one of the first things you should do is get the at-fault driver’s (also known as the tortfeasor) insurance information. However, in many instances the at-fault driver may not have enough auto liability insurance to cover your damages, such as past and future medical bills, past and future lost wages and pain and suffering. When a tortfeasor’s liability insurance fails to cover all of the costs of your damages, your uninsured/underinsured motorist (“UM”) coverage may kick in to cover any damages in excess of the tortfeasor’s liability insurance, up to the limits of your UM policy.

Not putting your UM carrier on notice of your lawsuit could prove detrimental to your ability to recover the full amount of insurance coverage available to cover your damages. If you have been in a wreck, first and foremost obtain the tortfeasor’s insurance information. Next, take a look at your own auto insurance policy to determine what UM coverage you have. If you have UM coverage, put your UM insurance carrier on notice of your accident and injuries you have sustained. Once you have filed a lawsuit, make sure that your attorney has sent your UM carrier a copy of the lawsuit.
