$2,375,000 Settlement – Commercial Vehicle Collision

This case involved the after-hours use of a company pickup by an employee who was under the influence of alcohol. The single-vehicle crash resulted in the death of a passenger in the truck. The larger dispute in the case involved whether the company negligently entrusted the truck to its employee, or whether the employee had permission to use the truck after hours. These facts had to be proven to hold the insurance company responsible for the drunk driver’s negligence.

Initially, the insurer offered zero asserting there was no coverage or permission. Through discovery we were able to force a favorable outcome for our client.
