$9,500,000 Settlement – Motel Shooting
A construction worker staying at an Atlanta area motel was the victim of a robbery and shooting late one night that left him with a permanent brain injury. Shiver Hamilton Campbell investigated the case and uncovered evidence establishing the owners and operators of the motel had reason to anticipate the incident and multiple opportunities to intervene and yet failed to do so. The assailants were rented a room at the motel the same night as the incident despite the concerns of the front desk attendant. Over a period of hours after checking in the assailants roamed the premises without any intervention by management. Their suspicious behavior was captured on the surveillance system; however, no action was taken by management. Eventually the assailants gained entry to the victim’s room where he was robbed and shot. He survived, but his life and his family’s life was forever changed. Shiver Hamilton Campbell filed suit on behalf of the injured individual and his wife and litigated the case for more than two years including extensive documents collection and review and the depositions of nearly twenty witnesses. At the outset of the case the defendants denied any liability, instead blaming the criminals and the defendant. As a result of Shiver Hamilton Campbell’s aggressive and thorough pursuit of justice the case settled prior to trial for $9,500,000.
